1. Agreement to Terms
These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and JDS Delivery (“we,” “us” or “our”), concerning your access to and use of the JDS Delivery application. By accessing the Application, you agree that you have read, understood, and agreed to be bound by all of these Terms of Use.
Data Privacy
JDS Delivery is committed to protecting your personal information and complying with all relevant data privacy laws. We process your data lawfully and transparently, and you have the right to access, correct, or request deletion of your data. For privacy concerns, contact privacy@jds-delivery.com.
Intellectual Property
All original content, features, and software provided by JDS Delivery are owned by JDS Delivery Philippines Inc. or its licensors, unless otherwise indicated. Commercial logos, trademarks, and materials (such as those of Jollibee and other brands) remain the property of their respective owners and are displayed for customer reference only. We respect third-party trademarks and copyrights and do not claim ownership of their brands or logos. You may not use, reproduce, or distribute our original content or third-party materials without permission. If you believe your intellectual property rights have been violated, please contact us.
2. The Service
JDS Delivery is a technology platform that connects users with independent third-party providers (Merchants and Riders) for the purchase and delivery of goods. We are not a restaurant, grocery store, or logistics company. We are not responsible for the quality of goods provided by Merchants.
3. User Accounts
You may be required to register with the Application. You agree to keep your password confidential and will be responsible for all use of your account and password.
Prohibited Activities
- Using the service for illegal purposes or transporting prohibited items (drugs, weapons).
- Creating multiple accounts to abuse promo codes.
- Harassing, threatening, or intimidating riders or merchants.
4. Orders and Payments
Order Acceptance: All orders placed through the Application are subject to acceptance by the Merchant and the Rider.
Pricing: Prices are displayed in Philippine Peso (PHP). Delivery fees and service fees are calculated based on distance and order value.
Cancellations: You may cancel an order only before the Merchant has started preparing it. Once preparation has begun, you may be charged the full amount.
5. 'Pabili' Service Specifics
For Pabili (errand) services, the estimated budget is an approximation. You agree to reimburse the Rider for the actual cost of items purchased as evidenced by the official receipt provided upon delivery.
6. Limitation of Liability
In no event will we be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the Application.
